J’ai l’immense honneur et privilège de vous annoncer que ma candidature a été validée pour l’élection municipale pour le poste de Maire de la Tunisie au sein d’ASGARDIAN. Je sollicite le soutien de tous les Tuniso-Asgardians pour gagner cette élection et faire appliquer notre programme:

Notre programme consiste en 4 points:

1/ Communiquer davantage sur Asgardia afin de sensibiliser les tunisiens sur notre projet et d’augmenter le nombre d’Asgardian de Tunisie ( objectif 1000 résidents par an)

2/ Créer un réseau Asgardian en Tunisie, pour faciliter les échanges entre les tunisiens de toutes les villes (via les outils de communication, les réseaux sociaux et autres outils)

ASGARD 01, The day Asgardians united the humanity around a common future !

This date marks the moment where the pioneers of Asgardia decided to adopt shared values and to shape a common and peaceful path for humanity to space ! By endorsing the declaration of unity Asgardians from all over the world started to bridge together the fragmented human society. These are not words to flatter, this is really what is happening.

Despite the ultra mixed community we are, Asgardians are humble, so welcoming and supporting. I felt my self with the right people in no time !

This second chart is about the distribution of elected MP according to their country of residence. And if we compare these results to those for citizens then we will note huge differences.

Places like China, Indonesia and India who are heavily present in number of registered citizens, have under-expected results for the parliament (despite a good number of seats was reserved to Chinese speakers and Hindi). We can observe also the opposite phenomenon for other countries.

- What's the explanation in your opinion ?

- Does your place of residence interfere in anyway with your involvement in Asgardia's activity ? Do you encounter any kind of difficulties related to the places you live in that stops you from being active and get more in touch with the rest of the Asgardian community ?

This post summarize an academic Law article, entitled

"Space Station Asgardia 2117: From Theoretical Science to a New Nation in Outer Space"

and written by : Humaid Alshamsi, Roy Balleste, Michelle L.D. Hanlon

W ithout a doubt, Asgardia will represent a new phenomenon within international law. The Asgardian project is the first to calls for the development of Astropolitics .

According to this article law experts are convinced that Asgardia will begin by existing as a de facto* nation-state, the longer it exists and keeps its population united and active, the more likely it will be that leaders of other nations will recognize Asgardia as a de jure* nation-state.

Asgardia may claim de jure recognition by its very own eventual development as a de facto nation. To enable the happening of this “natural” process it is crucial that Agardian leaders and citizens ensure these critical points:

• a) A permanent population
• b) A defined territory
• c) Government
• d) Capacity to enter into relations with the other states.

The article explains also that, to stay away from unnecessary wrangling of politics within the United Nations. Asgardians must avoid these pitfalls:

(1) the fact that the government is “provisional”

(2) the fact that it has not received democratic approval of the people

(3) the possibility of imminent overthrow of the Government

(4) the fact that its territory has not been precisely defined.

To resume, if we have a stable population, we keep our satellites network plan working to use it as territory, the government starts working and building foreign relations, we stay united, be an active community and keep evolving. Then we will be de facto a nation.

After that, a process of a de jure nation-state will start happening as the interest of other governments in having solid relations with Asgardia is expected to grow.  Other nations may be interested to have partnerships with Asgardia for its skilled human resources, for the innovative idea, for an easier access to space, for business …

It will more likely be a snowball effect, the more partners we gain the more we attract. The bigger our friendly-nations circle is, the bigger are our chances to be internationally recognized without complications.

Reading this makes you feel that finally getting the international recognition is not that impossible, which is true. However, it should makes also realize that it will not be a piece of cake. International relations do not just happen in 24 hours. It is obvious that there are tons of work to do and every one should participate.

Everyone is an Ambassador of Asgardia. Be the Ambassador you want to meet !

This treaty makes a declaration that the Moon should be used for the benefit of all states and all peoples of the international community. It suggests also that an international regime should be set up to ensure safe and orderly development and management of the Moon resources and sharing of the benefits from them.

The Moon agreement is considered by experts as a failure for international law. Despite 18 states ratified this agreement until January 2018, the main space powers as the United States, Russia and newcomers to the space club as China or Japan did not ratified this treaty.

While US position is oriented toward the rejection of this agreement, the Russian and the Chinese positions are still unclear. This situation makes that actually the Moon treaty is technically valid but do not have enough binding power. As the race for space mining has started, the need for such a treaty to be effective is everyday more important.

In the previous post we took a look to the American law about space resources. Today I share with you the Luxembourg's law about space mining.

On 13 July 2017 Luxembourg’s Chamber of Deputies passed a law, with near unanimity, regarding the exploration and utilization of space resources.

Luxembourg has been pretty active in the space mining business these days. Just last November, the EU country made a €25m investment and cooperation agreement with space mining company Planetary Resources.

“Space resources are capable of being appropriated,” the first article of the Luxembourg act states.

However this interpretation I read on http://spacenews.com caught my attention :

Both the U.S. and Luxembourg laws grant ownership to resources only after they have been extracted , avoiding potential conflicts with the Outer Space Treaty, which prohibits companies from claiming territory on celestial bodies.

I was on youtube watching a TMRO episode, where Mr Thomas Cheney (you should check his blog. Link below) was interviewed about space law, he opened a parenthesis on Space Mining Law. I didn't knew it already existed ! So I googled it. And I got two major results that made feel I'm as ignorant as a stone age person. I'll start here with the first one and I'll write about the second in the next post.

In 2015 the USA updated the legislation with the : Spurring Private Aerospace Competitiveness and Entrepreneurship (SPACE) Act of 2015 (see the image above). This act explicitly allows US citizens to "engage in the commercial exploration and exploitation of 'space resources' [including ... water and minerals]."

You can read this extract from the law you easily find on the site congress.gov : 

"Asteroid resource and space resource rights 
    ``A United States citizen engaged in commercial recovery of an  asteroid resource or a space resource under this chapter shall be  entitled to any asteroid resource or space resource obtained, including  to possess, own, transport, use, and sell the asteroid resource or space  resource obtained in accordance with applicable law, including the  international obligations of the United States.''."

Are we aware enough that the world in incredibly fast changing ?

Asgardian deputies will have to discuss such issues soon.

As I started recently my self documentation about Space Law, my research led me to know about Bogota declaration of 1976, where 8 Equatorial states (Brasil, Colombia, Congo, Ecuador, Indonesia, Kenya, Uganda, Zaire) affirm that the synchronous geostationary orbit, is a scarce natural resource, and is under the sovereignty of the equatorial states. I wanted to share this information with all of you as we all need to be aware of such situations that may affect in a positive or negative way our request to join the UN and later the establishment of our programmed space facilities.

Countries who signed the Bogota declaration say that "The Treaty of 1967 on “The Principles Governing the Activities of States in the Exploration and Use of Outer Space, Including the Moon and Other Celestial Bodies”, cannot be considered as a final answer to the problem of the exploration and use of outer space .... There is no valid or satisfactory definition of outer space which may be advanced to support the argument that the geostationary orbit is included in the outer space. The legal affairs subcommission which is dependent on the United Nations Commission on the Use of Outer Space for Peaceful Purposes, has been working for a long time on a definition of outer space, however, to date, there has been no agreement in this respect."

In the same declaration they also say that " The segments of the orbit corresponding to the open sea are beyond the national jurisdiction of states will be considered as common heritage of mankind . Consequently, the competent international agencies should regulate its use and exploitation for the benefit of mankind."

Pushed by the need to understand the complexity of the Asgardian project to establish a nation in the outerspace I started to read what the United Nations made as a framework for space law. 3 points caught my attention:

1/ As seen yesterday in the interview of the head of the nation. The presence of 2 companies monitoring the elections is confirmed.

2/ Legitimacy of all votes will be verified by these 2 compagnies.

3/ Each succefful candidate will be contacted individually.

==> "Asgardia is taking the election process seriously and not only will the votes be counted by the Counting Commission, who will check the voting logfiles, but to further help ensure that all the votes that candidates have were gained fairly and legitimately, several independent companies have also been asked to analyse the votes.

Once each of the votes have been verified, candidates who met the requirements (including the mandatory donation) will be contacted individually and informed of their successful election and formally invited to an event in Vienna which will be the first meeting of Asgardian Parliament."

I am very happy to read news from the head of the nation. It's motivating to see his vision of our future. The space arc is still a priority, terrestrial administrations too. But one thing caught my attention, this article cites "Two authorized foreign legal societies monitor the evolution of all votes, confirm their authenticity and legitimacy."

Anybody knows who are these 2 companies please ? How do they work ?
